Hola,

I need some help from within Spain.

I am reaseching this:

Especially 13.1.i (Exemption for 10-17 seaters in private traffic).

As you can read here, there is a lot of confusion:

It seems to be that it is unclear how the rulings are, on a car from a country that has implemented the exemption in 13.1.i, driving in a country that hasnt.

My challenge:
* I will visit Spain next year. Hopefully in a T4 10 seater, first reg. december 1999.
Without tachograph.... (As Denmark has exemption for 561/2006 according to 13.1.i).

And I would like to be prepared - the best thing would be to have the proper legal references printed in the car - in case I get pulled over and need to document that I can drive without tachograph,....

So - I would really appreciate any input, links, suggestions etc - to help me find out what the regulations are in Spain on this subject.

Hi Jens,
           As your vehicle is not a bus or truck, you don't really need tacograph at all, even if you use the van to carry people. So don't worry.

Thank you for your reply.

In Denmark the T4 can be registered as a bus with 10 seats. This is a bit technical, and due to special Danish legislation.
So, the T4 in mind is registered as a M2 (Category M2: Vehicles designed and constructed for the carriage of passengers, comprising more than eight seats in addition to the driver's seat, and having a maximum mass not exceeding 5 tonnes.
Which means that it falls into the 561/2006 category of vehicles that must follow the drive/rest-time regulation.

But - the next step, in Denmark such cars falls into the 561/2006 13.1.i exemption. for 10-17 person vehicles. That is perfect.

I try to find out how Spain has implemented the 561/2006 regulation, especially the 13.1.i exemption. And - if Spain hasnt implemted this exemption - then what are the requirements for a bus from Denmark, legally registered in Denmark without tachograph, to visit Spain.

It is a bit of a grey-zone...

I hope that someone in here can help me to find out the right way to go.

Hi Jeans, I've a M2 from 16 seats and it's necesary tacograf to ITV but if you only come to Spain for visit us or only turist you don't need to have this. In other case if you transfor your bus into motorhome the tacograf is not necesary because the M2 go to N1.

    Hi Jens I have not information about it, only my experience from my bus in accord of tranformation into motorhome and many changes does. The ingenier is the person who know about it very well.
